The present terms and conditions apply to contracts for the rental use of hotel rooms for lodging purposes, hotel’s conference and banquet rooms as well as all other goods and services rendered by the hotel for the customer.
I Contract
The contract is made when the hotel accepts the customer’s application.
At its own discretion, the hotel may confirm the room reservation in writing.
II Cancellation, Amendment
Cancellations and amendments must be sent in written form.
III Prices
Unless arranged differently, the prices include the VAT rate which applies on the date of the hotel’s supply.
IV Payment
Invoices must be paid within 10 days of invoice date.
V Place of jurisdiction
Place of jurisdiction is the place of the hotel
VI Ineffectiveness of single clauses
The ineffectiveness of single clauses does not touch the effectiveness of the general terms and conditions. Differing agreements have to be made in writing.
Events/ conference- and banquet rooms/ caterings
1. The reservation of rooms, area and the agreements of other supplies come into force upon the hotel’s confirmation. If the customer/ordering party is not the event organiser itself, or if a commercial agent or organiser is being used by the event organiser, then the event organiser shall be liable together with the customer as joint and several debtors for all obligations arising from the contract, insofar as the hotel has received a corresponding statement of the event organiser.
2. The assignment of rooms, glass cabinets or area establishes a lease agreement. A sublease/sublet needs a written consent of the hotel. The hotel reserves the right of the room allocation.
3. The organiser must inform the hotel until 4 workdays prior to the event about the final number of participants. If the number of participants changes by more than five percent, the hotel must be informed at the latest 4 business days before the start of the event. Such change must be approved in text form by the hotel. For changes exceeding this amount, the originally agreed number of participants minus five percent will be used. If there is an upward change, charges will reflect the actual number of participants. To ensure the accurate preparation, amendments of the previous agreements have to be agreed to by the hotel. In case of an amendment in the number of participants, the hotel reserves the right of changing the room allocation.
4. If an event cannot be conducted due to circumstances not caused by the hotel, the hotel reserves its right to claim the lease. According to the date of annulation and the added services that were planned, especially meals, the hotel is entitled an adequate compensation.The amount of the lease and the compensation are due to the hotel’s acceptance of order as well as the annex of these Terms and Conditions.
5. Events in the hotel and caterings that exceed midnight, will incur additional costs for staff. The required number of staff will be determined by the hotel.
6. Customer shall bear the risk of damage or loss for objects for exhibit or other items including personal property brought into the event rooms/hotel. The hotel assumes no liability for loss, destruction, or damage to or of such objects, also not for property damages, with the exception of cases of gross negligence or intent on the part of the hotel. Excepted here from are cases of damage caused as a result of death, injury to body or health. In addition, in all cases in which the safekeeping represents an obligation typical for a contract due to the circumstances of the individual case, release from this liability shall be prohibited. Decorations brought in must conform to the fire protection technical requirements. The hotel is entitled to require official evidence thereof. Should such proof not be given, then the hotel shall be entitled to remove materials already brought in at the cost of the customer. Due to the possibility of damage, the hotel must be asked before objects are assembled or installed.
7. Objects for exhibit and other items must be removed immediately following the end of the event. If the customer fails to do so, the hotel may remove and store such at the customer’s expense. If the objects remain in the room used for the event, the hotel may charge a reasonable compensation for use for the period that they remain there. The customer is free to prove that the above-mentioned claim was not created or not created in the amount claimed.
8. The customer may not bring food or beverages to events. Exceptions must be agreed in text form with the hotel. In such cases, a charge will be made to cover overhead expenses.
9. Advertisements containing invitations to interviews or sales events, need a written agreement by the hotel. If the announcement will be carried out without the acceptance by the hotel and/or essential interests will be affected, the hotel has the right to cancel the event; in this case paragraph 4 of the Terms and Conditions applies.
10. Furthermore, the hotel is entitled to extraordinary rescission of the contract for justifiable cause, e.g. if
- force majeure or other circumstances beyond the hotel’s control render fulfilment of the contract impossible;
- events or rooms are booked culpably using misleading or false information regarding material contractual facts, such as the identity of the customer or the purpose of his stay;
- the hotel has good reason to assume that the event might jeopardise the hotel’s smooth operations, security, or public reputation
without these being attributable to the hotel’s sphere of dominion or organisation;
- the purpose or the cause of the stay is illegal;
Upon justified cancellation by the hotel, the customer shall have no claim to reimbursement of damage.
Room reservation
1. The contract is made when the hotel accepts the customer’s application. At its own discretion, the hotel may confirm the room reservation in writing. The parties to the contract are the hotel and the customer.
2. If a third party placed the order on behalf of the customer, then that party shall be liable vis-à-vis the hotel for all obligations arising from the hotel accommodation contract as joint and several debtor together with the customer, insofar as the hotel has a corresponding statement by the third party.
3. If rooms are not used by the customer, the hotel must credit the income from renting the rooms to other parties and also for saved expenses. If the rooms are not otherwise rented, the hotel can demand the contractually agreed rate.
4. The cancellation fee is calculated from the agreed room rate exclusive of the reduction of costs caused by the cancellation. (annex)
5. Reserved rooms are available to the customer starting at 3:00 p.m. on the agreed arrival date. The customer does not have the right to earlier availability.
If a late arrival has not been agreed upon or the room has not been paid in advance, the hotel reserves the right to let the room to other guests after 6:00p.m. The right to re-let the rooms does not exclude the cancellation fee, if the rooms cannot be sold.
6. Rooms must be vacated and made available to the hotel no later than 12:00 noon on the agreed departure date. After that time, the hotel may charge 50 percent of the full accommodation rate (list price) in addition to damages so incurred for the additional use of the room until 6:00 p.m. (after 6:00 p.m.: 80 percent). The customer is at liberty to show the hotel that it incurred no or much lesser damages.

9. For groups reservations the hotel requires a prepayment of 50% of the expected revenue until 6 weeks prior to arrival. Bank charges are at the expenses of the orderer/guest. If the money receipts are not within the agreed time, the contract will be annulled. If the rooms are not otherwise rented, the hotel can demand the contractually agreed rate (annex). No cancellation charge will be claimed if the hotel receives the cancellation not later than 6 weeks prior to arrival. The date when the hotel received the letter is decisive.

If the revenue of the meals has not been agreed upon, the minimum menu price (banquet) x number of persons applies. The rental fee is declared in the hotel’s confirmation.

Only cancellations in a written form and confirmed by the hotel are legally effected. The calculation of the fee is not affected hereby.
